1. I missed my deadline to file with the SOS and OLLS. What do I do?

Unfortunately, we do not have the authority to waive this deadline. Section 24-4-103(8)(d)(III), C.R.S., provides: "If an agency issues a rule or an amendment to an existing rule for review by the committee on legal services pursuant to this subsection (8) without submitting the rule or amendment to the office of legislative legal services within twenty days after the date of the attorney general’s opinion on the rule or amendment pursuant to subsection (8)(b) of this section, the rule or amendment is void."

Please consult with your Assistant Attorney General (AG) to determine the appropriate next steps. You can close out this tracking number by filing a termination to prevent it from remaining unresolved.

After that, you can file a new notice of proposed rulemaking, and if necessary, proceed with an emergency rulemaking. It's important to consult with your AG first to confirm the appropriate course of action.

2. My deadline falls on a weekend or holiday. What can I do?

The e-Filing system will accept the AG opinion and your final filing on the next business day. However, be aware that waiting until the next business day may shift your publication date and push back your effective date.

Publishing deadlines: Per section 24-4-103(11)(b), C.R.S., the Colorado Secretary of State is charged with publishing the Colorado Register electronically at least once a month. The Secretary has opted to publish the Colorado Register twice a month electronically and the publishing deadlines are set to facilitate the publication process. These deadlines have been established long before the rulemaking process transitioned from paper filing to e-filing. The system is programmed to compile the submissions for each register during the applicable filing period. These deadlines are hardcoded into the electronic filing system and cannot be overridden.
